mr. rohrabacher: reserve. the chair: for what purpose does the gentleman from virginia seek recognition? mr. goodlatte: mr. chairman, i rise in opposition to the amendment and claim the time in opposition. the chair: the gentleman is recognized for five minutes. mr. goodlatte: mr. chairman, i strongly oppose the gentleman's amendment to strike the bill's provisions regarding section 145. the bill's provisions are strongly supported by the patent office. the amendment would strike one of the bill's most important reforms for preventing patent trolls from obtaining low quality patents and bringing extortion lawsuits. the bill's provisions are necessary because the supreme court's recent decision in appos vs. hiatt, to allow an applicant to evade extensive patent examination in the patent osts and instead present his evidence of patent ability for the first time in federal district court. a ditz trict judge would then be required to make de novo findings of patentibility. section 145 is outdated and unnecessary.
